By downloading, accessing, or using the Green Time Tracker mobile application ("App"), creating an account, or subscribing to our services, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Randolph Software LLC ("Company," "we," "us," or "our").

If you do not agree to these Terms, you must not use the App or our services. Your use of the App constitutes acceptance of these Terms as they may be amended from time to time.

Age Requirements

• You must be at least 13 years old to use the App
• Users between 13-17 must have parental or guardian consent
• By using the App, you represent that you meet these age requirements

2. Service Description

Green Time Tracker is a subscription-based mobile application designed to help users track and monitor their outdoor activities and time spent in nature. The App provides:

• Time logging and analytics
• Personal activity history and statistics
• Goal setting and progress monitoring
• Activity notes and journaling capabilities

Subscription Benefits

• Unlimited activity tracking
• Advanced analytics and insights
• Data export capabilities
• Premium support
• Regular feature updates

Free Trial

• 7-day free trial period for new subscribers
• Full access to all premium features during trial
• No charges during the trial period
• Automatic conversion to paid subscription unless cancelled

3. Account Registration and Security

Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining account confidentiality
• You must notify us immediately of any unauthorized access
• One account per person; sharing accounts is prohibited

Account Security

• You are solely responsible for all activities under your account
• Use strong, unique passwords
• Enable available security features
• Log out from shared devices

Account Termination

• You may delete your account at any time through App settings
• We may suspend or terminate accounts for Terms violations
• Upon termination, your data will be deleted according to our Privacy Policy

4. Subscription Terms and Billing

Subscription Plans

• Monthly Subscription: $9.99 per month
• Annual Subscription: $99.99 per year
• All prices are in USD and subject to applicable taxes

Free Trial Period

• New subscribers receive a 7-day free trial
• Trial begins upon subscription activation
• Cancel anytime during trial to avoid charges
• Trial converts to paid subscription automatically unless cancelled

Auto-Renewal and Billing

• Subscriptions automatically renew at the end of each billing period
• Payment will be charged to your Apple ID account
• Billing occurs 24 hours before the current period expires
• Subscription continues until cancelled by user

Apple In-App Purchase Terms

• All subscriptions are processed through Apple's In-App Purchase system
• Apple's Terms of Service apply to all transactions
• Billing and payment issues must be resolved through Apple
• We do not have access to your payment information

Cancellation and Refunds

• Cancel anytime through your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Refund requests must be made through Apple's refund process
• Access to premium features continues until subscription expires

Price Changes

• We may change subscription prices with 30 days notice
• Existing subscribers maintain current pricing until renewal
• Continued use after price change constitutes acceptance

5. User Content and Acceptable Use

Your Content

• You retain ownership of all content you create (activity logs, notes, photos)
• You grant us a limited license to use your content to provide services
• We do not claim ownership of your personal data or activity information
• You can export or delete your content at any time

Content License to Us

By using the App, you grant us a non-exclusive, royalty-free license to:

• Store and process your content to provide services
• Use anonymized, aggregated data for service improvement
• Display your content back to you through the App interface

Acceptable Use Policy

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others
• Create fake accounts or impersonate others

Content Removal

• We reserve the right to remove content that violates these Terms
• We may suspend or terminate accounts for repeated violations
• Users will be notified of content removal when possible

6. Privacy and Data Protection

• The Privacy Policy is incorporated into these Terms by reference
• You consent to data processing as described in our Privacy Policy

Location Data

• The App requires location permissions for GPS tracking functionality

• You can control location sharing through device settings
• Location data is stored securely and not shared with third parties

Health and Fitness Data

• The App may integrate with device health platforms (Apple Health)
• Health data sharing is optional and controlled by you
• We do not provide medical advice or diagnosis

7. Intellectual Property Rights

Our Intellectual Property

• The App, including all content, features, and functionality, is owned by us
• Our trademarks, logos, and brand elements are protected
• You may not use our intellectual property without written permission

Your License to Use

We grant you a limited, non-exclusive, non-transferable license to:

• This license terminates when your subscription ends or account is terminated

Restrictions

You may not:

• Distribute, sell, or sublicense the App

8. Service Availability and Performance

Service Availability

• The App may be temporarily unavailable due to maintenance or technical issues
• We do not guarantee 100% uptime or uninterrupted service

Maintenance and Updates

• We may perform scheduled maintenance with advance notice when possible
• App updates may be required for continued functionality

• The App relies on third-party services (Apple, GPS, internet connectivity)

Emergency Services

• The App is not intended for emergency situations
• Do not rely on the App for rescue or emergency communications
• Always carry appropriate safety equipment and communication devices

10. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM OUTDOOR ACTIVITIES OR ACCIDENTS

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of third-party rights
• Your outdoor activities or any accidents

11. Termination

Termination by You

• Cancel your subscription through Apple ID account settings
• Delete your account through App settings
• Contact support for assistance with account closure

Termination by Us

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Non-payment of subscription fees
• Legal or regulatory requirements

Effect of Termination

• Access to premium features ends immediately upon cancellation
• Your data will be deleted according to our Privacy Policy
• These Terms survive termination where applicable
• Outstanding payment obligations remain due

12. Dispute Resolution and Governing Law

Governing Law

• These Terms are governed by the laws of California, United States
• Any disputes will be resolved in the courts of California
• You consent to the jurisdiction of these courts

Arbitration Agreement

For disputes involving claims under $10,000:

• Disputes will be resolved through binding arbitration
• Arbitration will be conducted by the American Arbitration Association

• Each party bears their own costs unless otherwise awarded

Class Action Waiver

• Continued use after changes constitutes acceptance

14. Apple App Store Specific Terms

Acknowledgments

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App

App Store Rules

• Usage must comply with Apple's App Store Terms of Service
• Apple may remove the App from your device for violations
• You represent that you are not in a country subject to U.S. embargo

Third-Party Beneficiary

• Apple is a third-party beneficiary of these Terms
• Apple may enforce these Terms against you
• Upon your acceptance, Apple has the right to enforce these Terms

15. General Provisions

Entire Agreement

• These Terms, Privacy Policy, and App Store terms constitute the entire agreement
• No other representations or warranties apply
• Modifications must be in writing and signed by both parties

Severability

• If any provision is unenforceable, the remainder remains in effect
• Unenforceable provisions will be modified to be enforceable while preserving intent

Assignment

• You may not assign these Terms without our written consent
• We may assign these Terms in connection with a merger or sale

Force Majeure

• We are not liable for delays or failures due to circumstances beyond our control
• This includes natural disasters, government actions, or technical failures

Survival

• Provisions that should survive termination will remain in effect
• This includes intellectual property, liability limitations, and dispute resolution
